Arbitration, a form of alternative dispute resolution (ADR), is a legal technique for the resolution of disputes outside the courts, wherein the parties to a dispute refer it to one or more persons (the "arbitrators", "arbiters" or "arbitral tribunal"), by whose decision (the "award") they agree to be bound. It is a settlement technique in which a third party reviews the case and imposes a decision that is legally binding for both sides. Other forms of ADR include mediation (a form of settlement negotiation facilitated by a neutral third party) and non-binding resolution by experts. Arbitration is most commonly used for the resolution of commercial disputes, particularly in the context of international commercial transactions. The use of arbitration is far more controversial in consumer and employment matters, where arbitration is not voluntary but is instead imposed on consumers or employees through fine-print contracts, denying individuals their right to access the courts.

Arbitration can be either voluntary or mandatory and can be either binding or non-binding. Non-binding arbitration is, on the surface, similar to mediation. However, the principal distinction is that whereas a mediator will try to help the parties find a middle ground on which to compromise, the (non-binding) arbitrator remains totally removed from the settlement process and will only give a determination of liability and, if appropriate, an indication of the quantum of damages payable.

A. Arbitration is for players with between three and six years of major league service, along with a small percentage of those with between two and three years. No player MUST go into arbitration. For one thing, only the team can offer arb. For another, they can work out a deal through continued negotiation and never actually go before the arb board. As arbitration cases can be fairly contentious and lead to some bad blood, avoiding it (in favor of striking a deal) is widely preferred. Offering and accepting arbitration does extend the negotiation window. Arbitration can be offered to players with greater service time, but they can decline it. If arb is not offered to a free agent and he signs elsewhere, his former team is not eligible to… [cont.]

Does anyone know how to petition the court to confirm an Arbitration Award?
Q. It was a binding arbitration in the state of Oregon. The arbitrator issued a notice of award, Arbitration Award, and a General Judgement and money award. I took it to the circuit court and they were unsure how to process this! I am limited to file this within 20 days... I have 16 days to file the petition... do I file the award and the judgement at the same time?

Why is there salary arbitration in the MLB?
Q. IMO, the players make enough money as it is. Plus, it causes some teams to keep players in the minors for too long in order to prevent starting the "arbitration clock." I think it does more harm than good.

A. This is one of the many complicated issues that was hammered out in the early days of free agency. In the old days with the reserve clause, an owner could bind a player to a team for life and treat him like an indentured servant and pay him as little or as much as he pleased. Players were forced to play hurt and often had their careers ruined by greedy owners and G.M.'s. After free agency and salaries started to rise the owners got very nervous and it was they who insisted on some sort of arbitration system which in turn they blew up by offering huge contracts to players like Albert Belle who got millions of dollars and never panned out but his contract (and A-Rod's and others like it) throw the whole system out of whack.
