What can you tell me about mediation as a career?
Q. A certification course is available to me. What is the pay for professional certified mediators? Are they self-employed or, if not, who employs them? Is it easier to find employment in large cities, or are jobs available in rural / small town areas? What is the difference between mediation and conflict resolution? I plan to work in Texas.

A. Mediation is a type of conflict resolution (also called alternative dispute resolution). In California, most mediators started their careers as attorneys. A lot of them were also judges. I don't think certification matters as much as experience. You may have to volunteer to do a few mediations (for free) to get experience if you want to mediate in the legal field. If you mean family law mediation, that may be different. It depends on the type of mediation you want to do.

How to write a letter to the other parent requesting we attend mediation?

He'll tell his side, you'll tell your side, unless someone interrupts, (they will be told to wait their turn) it will be just a fact finding conference. Both parties will hear each others testimony. Quite often the truth is easy to see. However, It IS a "mediation" which means they will try to find a way you can work together, and avoid law suits. Good luck.

Can my husbands ex-wife have us pay her legal fees, if we do not agree to the mediation agreement?
Q. My husband just completed child custody mediation because his ex-wife is brainwashing his two boys Eric 7 (autism spectrum disorder) and Kyle age 3. Basically, the mediator went off of who was the better story teller. The mediation recommendations are ridiculous, won't even go there. Now HER attorney is threatening us that if we do not sign the mediation recommendations that she will take us to court and have us pay his Ex's legal fees. Can she do that?

A. You really need to consult a lawyer at this point, or even Legal Aid Society, who will be able to assist you for almost nothing or for free. Check you local area Bar Association website or Legal Aid website to see when they are running free consultation clinics in your area. I'm a first year law student, and this sort of question really might depend on the jurisdiction you are in, what the specific law is in your state, etc. You really need to consult with an attorney at this point, and they are the only person that will be able to answer your question.

Why does the defense want to adjourn mediation process in lawsuit?
Q. We thought it was over and yet the defense lawyers now want to adjourn the mediation hearing that tries to award a settlement. They say they are not ready...our lawyer wants to adjourn and seems pleased that they want another 60 days. What do you think?

A. Well it's pretty much a settlement period. It's where their doctors try to dicredit your actul injuries & try to settle for a lower amount than you're asking. I'm hoping you have an attorney as well. Yet if you can not come up with an agreeable amount then the mediator steps in & settles for you. Actually my lawyer got good hooks on the other sides doctors once because I was personally going to a specialist & the person at faults insurance company sent me to a regular physician so my specialist towered over what their physician said & I won the case greatly :o) this will give you a hint of what will happen...but dont worry...everythng will be fine

Q. My lawyer says that we will be having a mediation in front of a magistrate and that will decide if we are going to a jury trial. I'm not too sure what this means, does it mean they are going to try to make a monetary deal? The EEOC took it over and they are the ones going to mediation for me, so I don't and can't give any more details, but you 2 have been helpful. Thanks so much!

A. Mediation is a settlement conference, period. In this case it's before a Magistrate judge who will act as the mediator. S/he won't hear the trial & everything old him/her is confidential. They will try to determine the bottom lin for each side & see if they can work you toward a settlement. No one will force you to do anything; but this is the last effort of the court to promote a settlement before trial. Whenver you have questions about procedures like this, ask your lawyer to explain it to you until you understand exactly what's happening. That's what you are paying them for.

Q. I have court next month and have non clue on how to handle the matter. I have two little girls 2 year old and a 3 year old which I am fighting to keep save from their meth addict father. What is hindu mediation like, and is it very different from Buddhist meditation?

Buddhist meditation is based on anatta (no-self, that there's no such thing as a real 'you', which rules out the possibility of having a soul), anicca (nothing is permanent, which rules out the existence of an eternal god), and dhukkha (nothing is permanently satisfactory, except nirvana). Is this in conflict with hinduism? What do hindus meditate on?

Is there a proven mediation to improve cirrhosis of the liver?
Q. Doctors have told me cirrhosis of the liver is irreversible so deal with the fact this condition will certainly shorten my life. I understand that but I have read that the liver CAN rejuvenate itself to some degree under certain circumstances if you obstain from the harmful elements which are under your control, alcohol, etc. Is there anything I can "take" or "do " to maintain or improve the condition of my liver besides eat right and take care of my body, or am I too late? I' 60.

How do I modify mediation orders in Texas due to changes after mediation?

A. Mediation orders are those orders you agreed to, and cannot be modified except by further agreeement. Things do change, but if by change you mean that the other party has not lived up to their agreement, then you need to file a motion to enforce, not to modify.

A. Mediation orders are those orders you agreed to, and cannot be modified except by further agreeement. Things do change, but if by change you mean that the other party has not lived up to their agreement, then you need to file a motion to enforce, not to modify.

A. Try a meditation CD. Dr. Andrew Weil has one out. I used it to meditate on when I took a stress management course. He talks you through, with a stream-of-consciousness kind of commentary. It is easy to follow, and helps get your mind of other things.
