How to separate mediation issues from arbitration issues?
Q. My divorce agreement says the ex and I must "mediate" if there's a dispute. Yes, there are several disputes. But my ex keeps saying we need "arbitration". There are some issues for which I'd like mediation and keep some decision power, and some issues I'd agree for an arbitrator to decide for us. HOW do I make sure the issues stay separated during mediation/arbitration?

A. mediate... arbitration... when you get right down to it... they are basically the same.

What are the negative impacts of adult interference for peer mediation?
Q. I am doing an assignment for a class about peer mediation. I am having a hard time trying to answer the question. It asks, "What are the negative impact of adult interference in peer mediation?" So far I have answered: -teacher interrupts the conversations between the mediators and students who are involved with the problem -teacher may not let the students solve their own problem. Does anyone else have any ideas that could help me? Thanks

A. One thing is that a student might not be comfortable sharing information with a teacher, but is with a fellow classmate or friend. If he or she doesn't open up completely, he or she may not be able to be helped as much. Also, the teacher may think lower of the student or treat him or her differently after learning about a situation. It is not fair for a student to be treated badly because of a problem in his or her life. Finally, a student may have a problem with that teacher or another teacher, and would not want the teacher to know for fear of the teacher finding out. - Anonymous

How should I dress for a legal mediation?
Q. I will be participating in a legal mediation with an injured family member. The plaintiffs, a private transport company, and another injured plaintiff will be meeting to mediate a settlement. Our attorney has described the community as "conservative" both in lifestyles and judgements. Between you and I, we'd prefer not to go to court. Jacket and tie? Or, suit and tie?

A. I would run with "business casual". Appear well dressed and respectful, but no need to go the suit and tie point. After all you are not the attorney.

A. You should compare a mediator to an investment. Realize that by agreeing on terms, you can even file an uncontested divorce which equals out to even greater savings, and even the ability to wrap up your divorce much faster than if you had numerous court dates and motions slowing everything down.

What is hindu mediation like, and is it very different from Buddhist meditation?
Q. Buddhist meditation is based on anatta (no-self, that there's no such thing as a real 'you', which rules out the possibility of having a soul), anicca (nothing is permanent, which rules out the existence of an eternal god), and dhukkha (nothing is permanently satisfactory, except nirvana). Is this in conflict with hinduism? What do hindus meditate on?

A. A mediator is an independent person who does not have an interest in the outcome, and does not represent either party. They listen to both sides, and assists you both by attempting to reach an agreement. Mediation is not binding, and does not prevent you from continuing with your complaint.

A. I know it sounds like a good idea in theory, but it doesn't work well in practice. I remember the 'peer mediation' kids at my school - the only ones who got involved were the ones who wanted to be able to have power over kids they didn't like, and gossiped so much that everyone knew about every issue within hours. After a week, no one ever went to them again.

A. you need to call and follow up with them at least 2x a week. It could take anywhere 1month to 6 months until they actually give you the trial modification documents. What happened to the previous modification-they had a legal binding agreement may warrant an attorney. www.loansafe.org-- is a free online community that is great for this type of thing-check it out.

what is the difference between arbitration and mediation?
Q. Is is only that one can make decisions while the other can only suggest or help? Don't want to be dense, but I am a little confused.
Asked by Olivier H - Mon May 7 19:17:02 2007 - - 3 Answers - 1 Comments
A. Both mediation and arbitration fall under alternatives to dispute resolution. However, there is a difference between the two. Mediation involves the parties meeting with a neutral person who attempts to help the parties resolve the matter. A mediator works as a "neutral party" to help facilitate a settlement without making a decision. In Arbitration, a neutral party would hear from both parties and issue a decision that would be binding on both parties. Both parties are "stuck" with the decision. Arbitrators do not attempt to facilitate a resolution.

A. That, the parents would first have to work out amongst themselves as a family and improve communications. Because 'a representative of the family' had worked issues out with the school in a mediation process it is now legally presumed that issues were worked out between 'the family' and 'the school' during a mediation process. The school does not double check to see if all members of the family agreed to this document. Only one representative of the family minimum (or if at least 18, the student themselves) has to attend the IEP process and sign off on the documents for mediation to legally be considered successful. Now another IEP can be called to modify that process and create another document, but this current document which… [cont.]
